VIOLATING THESE TERMS WILL TERMINATE
THE TRANSACTION BETWEEN CLIENT AND ARTIST.
THE ARTIST HAS THE RIGHT TO REFUSE A COMMISSION
OR CLIENT, PLEASE FULLY READ THESE TERMS.
BY COMMISSIONING ME, YOU AGREE THAT YOU ARE 18 YEARS OF AGE OR OLDER.

General Terms

-Payment-

| Full payment is expected before service as payment also secures a slot.
| Payment and response is required within 24 hours, slots will not be held.
| Partial payment/payment plans are only offered to larger projects or pieces that reach over the 3 digit mark (Example: 1.5k and up) and will be discussed in detail via email.
| Emails generally will not be checked after payment has processed until time of delivery/artist needing to contact client: if forms are filled out incorrectly or information is missing it will likely be missed in the final piece and edits will incur a fee.
| Commissions will not be given to payment plan clients until payments are completed.
| If payments are stopped with no sign of fulfillment, I will keep all previous payments, there are NO refunds.
| I reserve the right to cancel your commission at any time. If I decide to cancel your commission, you will receive a full refund, regardless of the progress I’ve made.
| If you decide to cancel your commission, you will only receive a full refund if it has yet to be started. Otherwise, your refund will be determinate on the amount of work complete.
⛧ A REFUND WILL NOT BE GIVEN IF THE ARTWORK IS COMPLETE.

Invoice will be via PAYPAL only, USD

-Progress and Deadlines-

Time spent on commissions vary, but should be completed at up to three months depending on factors such as;
Health, complexity, queue, work, school or family issues.The Client will be notified if issue arises.Deadlines are negotiable ahead of time and will come with an added rush fee (price dependent on date)
An ETA will be given accordingly.Works in progress will NOT actively be given unless the client specifies beforehand that they would like to see progress, or there is a question or concern from the artist.
WIPS will consist of early sketch and base color upon request only. Failure to respond within 48 hours will result in the progress of the work without the client's input.| If emails and payment are not replied to within the first 24 hours of receiving confirmation of acceptance, the client rescinds their slot and the artist will move on to the next available client without notice.| Rejection emails are NOT sent to rejected inquires.

Conditions

| You MAY NOT commission characters you do not own without the original owner’s consent (Fanart is negotiable)| No glorification of violence, terrorism, hate speech and violent extremism towards any specific person, group or brand especially communities of minorities| No sexualized depiction of an underage (under 18 years of age) person or character (loli, shota). This also includes adult real life people or characters who are modelled after children or catering towards the sexualization of minors| No heavy fetish works such as scat, vomit play, beastiality, etc-| No overly specific requests (walls of text)|SFW commissions will be similar to examples shown (waist/thigh up with simple usually solid color bgs)
Full body and complex compositions are reserved for NSFW and commercial pieces.|Commercial use must be disclosed at the beginning prior to acceptance of work| Use in AI generation, or for the use of AI art is strictly prohibited.

Copyright & Usage Policy

The artist holds the rights to the produced drawing, not the commissioner. Therefore the following is within the artist’s rights;

| Promote their self with the art piece on any platform (this includes but is not limited to posting onto subscription sites such as Patreon, UNLESS piece is PRIVATE which will incur additional fees)
| Present the artwork as sample or portfolio piece to other individuals or groups
| Publish it physically for non-commercial purposes only.
The artist is NOT allowed to turn the artwork or design into profitable goods or merchandise that will give gain personally or to any other individual or group who is NOT the client.PLEASE LET ME KNOW BEFOREHAND if your commission should remain private. I will respect and retain your privacy if desired, however this will also incur additional fees.

The client is allowed to;

| Use the artwork as a design for personal use only; such as paper-based works, merchandise, apparel or tattoos for ONLY themselves
But cannot use it as goods to sell or profit commercially| Crop or edit for personal layout purposes, icons, banners, etc. as long as the original content of the artwork is not edited. Credit and link back must be provided.

BREAKING THE COPYRIGHT'S TERMS IN ANY FORM WILL TAKE AWAY ANY RIGHT THE CLIENT HAD OVER THE WORK.The following is considered copyright infringement| Reproducing the artwork commercially (making money out of it, in any way, without the knowledge or consent of the artist)| Use in Ai art/Ai generation_{*Any and all work for
VTubers/streamers/YouTubers pertaining to the promotion of their online persona will automatically incur a commercial fee. This is non-negotiable.
Commercial Use is defined as but not limited to:
Stream Assets
Video Assets
Info Graphic Use (like stream schedules or event advertisements)
Stream/Video Thumbnails
Merch - digital or physical
Emotes
Posters or other Prints
Anything you intend to use to generate revenue or push your brand.}| Taking credit for the creation or crafting of the artwork itself
| Removing or altering any watermarks/signatures without the consent or knowledge of the artistYou may purchase commercial rights from the artist (min starting at 200usd) price will vary depending on intended use. Contact the artist for more info
